2. Warranty Coverage and Period
The warranty coverage provided by TranEx Roads & Traffic Pty Ltd applies for a period of two years from the date of purchase, as recorded on the official sales invoice. This warranty is non-transferable and applies exclusively to the original purchaser of the product. It extends solely to products that have been purchased from TranEx or an authorised distributor, agent, or reseller. The coverage is limited to manufacturing defects that arise under normal and intended usage conditions.
To qualify for warranty protection, the product must have been installed and used in accordance with the manufacturer’s guidelines. Any deviation from these specifications, including improper handling, misuse, or installation by an unqualified technician, will void the warranty. Additionally, the product must not have been modified, altered, or subjected to conditions beyond its designated operating environment.
The warranty does not cover consumable parts, normal wear and tear, or cosmetic damage that does not impact the functionality of the product. Furthermore, it does not extend to any secondary damage resulting from product failure, including consequential losses such as loss of business, lost profits, or third-party damages. Under Australian Consumer Law, a customer may still be entitled to a remedy
even if the defect falls outside the specific exclusions of this warranty.
3. Conditions for Warranty Claims
A warranty claim under this policy is only valid where the defect arises due to manufacturing faults. In order to initiate a claim, the original proof of purchase, such as an invoice, receipt, or order confirmation, must be provided. Customers are required to lodge a warranty claim by contacting TranEx directly via phone or email and providing detailed evidence of the fault, including photographs or videos where applicable. The defective product must then be returned to a TranEx-approved assessment location, at the expense of the customer, for inspection and verification.
The warranty will not be applicable in circumstances where the product has been installed incorrectly, misused, or subjected to external factors outside its intended design parameters. This includes, but is not limited to, exposure to excessive moisture, extreme temperatures, corrosive substances, electrical surges, or physical impact. The use of the product in an environment that exceeds its specified operational limits will result in the warranty being voided.
Furthermore, any unauthorised modifications, alterations, or repairs carried out by third-party service providers or end users will render the warranty null and void. In the case of electrical components, warranty claims will not be accepted if failure is due to incorrect voltage input, fluctuating power supply, poor wiring, or the use of incompatible accessories. Where the failure is due to an external power supply fault or a site-related issue, the responsibility rests with the consumer rather than
TranEx.
All warranty replacements or repairs will be conducted at the sole discretion of TranEx, which reserves the right to repair the product, replace it with an equivalent item, or issue a refund where appropriate. If a replacement unit is provided before the return of the defective product, TranEx may require a security deposit, which will be refunded upon receipt of the faulty unit. Any replacement product will continue to be covered only for the remainder of the original warranty period and will not reset or extend the coverage period.
4. Warranty Claim Process
In order to initiate a warranty claim, the customer must first contact TranEx and provide a description of the issue, including any relevant supporting materials such as photographs or videos. The warranty department will assess the initial claim and may request further details or evidence to verify the nature of the defect.
Once the claim is acknowledged, the product must be returned to TranEx for assessment. It is the responsibility of the customer to arrange for transportation and associated costs, including any necessary packaging to prevent damage during transit. Failure to return the product in an appropriate condition may affect the outcome of the warranty claim.
Upon receipt, the product will undergo a comprehensive evaluation to determine whether the defect is covered under warranty. If the defect is found to be a result of a manufacturing fault, TranEx will undertake repair or replacement at no cost to the customer. However, if the issue is determined to fall outside the warranty terms, the customer will be notified and provided with alternative solutions, which
may include repair at an additional charge.
It is important to note that labour, site access, removal, and reinstallation costs are not covered under this warranty. This means that any expenses incurred for installing or removing the product will be the responsibility of the purchaser. Additionally, delays in processing warranty claims due to failure to provide requested information or return the product in a timely manner will not be considered grounds for compensation.
5. Electrical Items and Warranty Limitations
Specific exclusions apply to electrical products, particularly where failure is attributed to factors beyond manufacturing defects. The warranty will not cover failures caused by incorrect electrical input, improper installation, or fluctuations in power supply. Products must be installed in accordance with industry standards and local electrical regulations to qualify for warranty protection.
Additionally, products that are not explicitly designed for outdoor use but have been installed in an external environment will not be eligible for warranty coverage. Where a product has been exposed to water ingress, dust contamination, or extreme weather conditions, it will be deemed as having been used outside its intended operational specifications.
If an electrical failure occurs due to an incompatible accessory, third-party component, or external interference, the responsibility will fall upon the consumer rather than TranEx. Customers are encouraged to consult a qualified electrician prior to installation to ensure compatibility with power supply requirements.
6. Consumer Rights Under Australian Consumer Law
This warranty operates in addition to, and does not exclude or limit, consumer rights as prescribed by the Australian Consumer Law under Schedule 2 of the Competition and Consumer Act 2010 (Cth). The Australian Consumer Law provides statutory guarantees that products must be of acceptable quality, fit for their intended purpose, and free from major defects.
Under the Australian Consumer Law, consumers are entitled to a replacement, repair, or refund where a product experiences a major failure. A major failure is defined as a fault that renders the product unusable for its intended purpose and cannot be remedied within a reasonable timeframe, creates a safety hazard or poses a risk of harm to persons or property, would have resulted in a consumer choosing not to purchase the product had they been aware of the defect, or cannot be resolved through standard repair procedures.
For faults that do not constitute a major failure, the manufacturer retains the right to repair or replace the product within a reasonable timeframe, as opposed to issuing a refund. If the failure is deemed to be of a minor nature, the consumer must accept the remedy provided by TranEx.
It is also important to note that while this warranty outlines specific exclusions, a customer may still be entitled to a remedy under consumer protection laws. In the event of a dispute regarding warranty coverage, customers have the right to seek assistance from the Queensland Civil and Administrative Tribunal, the Tasmanian Civil and Administrative Tribunal, the Queensland Office of Fair Trading, or
Consumer, Building and Occupational Services Tasmania.
7. Governing Law and Amendments
This warranty is governed by the laws of Tasmania, with disputes to be resolved through the relevant state tribunals. TranEx reserves the right to update or modify its warranty terms at any time. Any revisions will apply only to purchases made after the effective date of the amendment.
By purchasing and using a TranEx product, consumers agree to the terms outlined in this warranty policy. For any additional questions or clarifications regarding warranty coverage, customers are encouraged to contact TranEx’s warranty department.
8. Limitation of Liability
Limitation of liability is a crucial aspect of TranEx Roads & Traffic Pty Ltd’s product warranty and website terms and conditions, ensuring that the company is not held responsible for indirect, incidental, or consequential damages resulting from the use, misuse, or failure of its products. This limitation of liability extends to loss of business, loss of revenue, data loss, third-party claims, and any costs incurred due to product malfunction. Under the Competition and Consumer Act 2010 (Cth), TranEx’s liability is limited to the extent permitted by law, and remedies available to consumers are confined to repair, replacement, or refund of defective products in accordance with Australian Consumer Law. This provision is essential in protecting the company from financial exposure while maintaining compliance with statutory consumer protections.
9. Force Majeure
A force majeure clause ensures that TranEx is not held liable for any failure or delay in fulfilling its obligations due to circumstances beyond its reasonable control. Such circumstances may include, but are not limited to, acts of God, natural disasters, governmental actions, industrial disputes, supply chain disruptions, wars, acts of terrorism, and pandemics. In the event of a force majeure occurrence, TranEx reserves the right to suspend or modify its warranty commitments until the extraordinary event ceases to affect its ability to perform its obligations. This clause is significant in recognising that certain external events are unforeseeable and beyond the company’s capacity to mitigate, thereby preventing liability for non-performance arising from such events.
10. Product Installation
Product installation and use requirements are integral to ensuring that TranEx products function as intended. Customers are responsible for ensuring that all products are installed by a qualified professional in accordance with Australian and New Zealand Standards and any applicable local regulations. Any failure to install or use the product in compliance with these standards will render the warranty void. TranEx disclaims any liability for damages caused by incorrect installation, negligence, or failure to adhere to relevant laws and industry standards. This provision reinforces the importance of professional installation and ensures that the company is not liable for defects or failures resulting from customer errors or non-compliance with installation guidelines.
11. Product Recalls and Safety Notices
Product recalls and safety notices are managed in accordance with Australian Consumer Law and New Zealand Consumer Laws to ensure that consumers are informed of any identified defects or safety risks associated with TranEx products. In the event of a product recall, TranEx will take reasonable steps to notify affected customers and provide instructions regarding the return or replacement of the defective product. Customers are responsible for registering their product warranty where required to facilitate communication regarding safety updates. The recall process ensures compliance with consumer protection laws and demonstrates TranEx’s commitment to product safety and customer welfare.
12. Governing Laws
The governing law and jurisdiction clause establishes that all disputes relating to TranEx’s warranty terms and conditions are subject to the laws of Tasmania. Any legal action arising from these terms must be brought before the relevant state tribunal, such as the Queensland Civil and Administrative Tribunal (QCAT) or the Tasmanian Civil and Administrative Tribunal (TASCAT). This provision ensures that any legal disputes are adjudicated within a defined legal framework, providing certainty to both TranEx and its customers regarding the applicable jurisdiction and governing law.
13. All Rights Reserved
TranEx reserves the right to amend its terms and conditions at any time, with changes applying only to purchases made after the new terms become effective. Customers are encouraged to review the warranty and website terms regularly to ensure they remain informed of any updates. This clause grants TranEx the flexibility to adapt its policies in response to changes in legal requirements, industry practices, or business needs, ensuring ongoing compliance with consumer protection regulations.
